These GTC apply to all products and services on the www.agrologica.hu website. By using the website and ordering the products and services, you declare that you agree with the provisions of these GTC and accept them for yourself.

The content of the contract concluded between us – in addition to the provisions of the applicable legislation – is determined by these GTC and the additional information on the website.

Before finalizing your order, you must read the provisions of these GTC, as by purchasing via the website you expressly accept the provisions of these GTC, which form part of the contract to be concluded.

The language of the resulting contract is Hungarian, they do not qualify as a written contract, however, by managing it in our own database, the contract can be accessed later.

  1. Product selection and ordering
    We provide visitors with pictures, information and detailed data about the products on the webshop. If necessary, we are available by phone and email for more information.

You can start the purchase intention for the selected products with the add to cart button.

The product in the basket can be finalized by pressing the checkout button.

Our automatic invoicing system issues an invoice or receipt for the customer’s order at the checkout. After providing the required data, selecting the delivery and payment terms and accepting the GTC, we will consider the order final.

Our system will send you an automatic confirmation email within 48 hours of placing your order. If the confirmation e-mail is not received within 48 hours, you will be released from the obligation to place an order. You can check the quantity, price, delivery address and payment method of the ordered product in the confirmation e-mail.

The order will be final if confirmed by customer service by phone / e-mail.

2. Prices

Our prices are in HUF, which includes 27% VAT, but do not include shipping costs.

The delivery cost can be found during the purchase process before the order is finalized, as well as in the provisions of these GTC.

If there is an error or defect in the products or prices in the web store, we reserve the right to make corrections. If, despite all the diligence of the Service Provider, an incorrect price is indicated, in particular the HUF 0, EUR 0 or HUF 1, EUR 1 price that is obviously incorrect – significantly different from the well-known, generally accepted price of the product, or due to a system error, the Service Provider is not obliged to to deliver at the wrong price, but may offer delivery at the correct price, in the knowledge of which the Buyer may withdraw from his intention to purchase.

In the event of an incorrect price, there is a striking disproportion between the actual and indicated price of the product, which a buyer needs to perceive immediately. Pursuant to Act V of 2013 on the Civil Code (Civil Code), the contract is concluded by mutual and unanimous expression of the will of the parties. If the parties cannot agree on the terms of the contract, ie there is no statement expressing the will of the parties mutually and unanimously, then no contract is validly concluded. Based on this, an order confirmed at an incorrect / erroneous price is considered a void contract.

3. Shipping

The products are delivered in by Karagiannis Transports, by the Post, GLS or DPD courier services.

The terms and prices of the delivery are announced in detail in the delivery terms menu item on the website.

We undertake the delivery of the products within 3-4 weeks after the confirmation. If the product is out of stock, we will notify the buyer in advance of the change and the expected delivery date.

4. Payment methods

Online payment by credit card: We provide credit card payment to customers through the online system of Barion Payment Zrt. The site is operated by Barion Payment Zrt. ., Community tax number: HU25353192, activity license number: H-EN-I1064 / 2013, electronic identification of electronic money institutions: 25353192) as an electronic money institution.

For our web store, Barion provides the possibility of card acceptance through its secure online card acceptance system using the SSL protocol. When paying by credit card, you will be redirected to Barion’s payment page, so the payment will be made directly on the page operated by the Bank and operating in accordance with the rules and security regulations of international card companies. The online store does not have the data, number or expiration date of your card or the account behind it in any form.

To pay by credit card, you will need the following information:

5. Right of withdrawal for the consumer

Section 8: § (1) of Act V of 2013 on the Civil Code (hereinafter: the Civil Code). According to point 3, only a natural person acting outside the scope of his profession, self-employment or business is considered to be a consumer, and the right of withdrawal without justification applies only to these persons. The consumer may withdraw from the contract within 14 days, starting from the date of receipt of the product by the consumer or a third party other than the carrier designated by him, or 14 days in the case of a service contract, from the date of conclusion of the contract.

The consumer may also exercise his right of withdrawal under this section between the date of conclusion of the contract and the date of receipt of the product.

The consumer’s right of withdrawal 45/2014. (II.26.) May be exercised by filling in the model declaration of withdrawal in Annex 2 or by making a clear statement to that effect.

In the event of an appropriate withdrawal or termination pursuant to Section 22 of the Government Decree, the seller shall reimburse the amount (ie the consideration paid by the buyer including the delivery fee) in the same way as the payment method used by the consumer from the time the seller becomes aware of the withdrawal. refunds within days.

The seller may withhold the amount returned to the consumer until the consumer has returned the product or has confirmed beyond reasonable doubt the return.

It is the buyer’s responsibility to ensure, upon receipt from the courier, that the package includes all ordered products and all goods are intact.

Please inspect the package in front of the courier upon delivery, and in the event of any damage to the products, ask for a report and do not accept the package. We cannot accept subsequent complaints without minutes!

6. Warranty and guarantee

In the event of faulty performance by the Seller, you may assert a warranty against the Seller in accordance with the rules of the Civil Code.

As part of this, the consumer may request a repair or replacement, unless it is impossible to meet the demand of your choice or the Seller would incur a disproportionate additional cost compared to the fulfillment of another demand. If you have not requested or could not request the repair or replacement, you may request a proportionate delivery of the consideration or the defect may be repaired at the expense of the Seller, or repaired by someone else, or – ultimately – withdraw from the contract.

You may transfer from your chosen supply warranty to another, but you will bear the cost of the transfer, unless it was justified or given by the Seller.

You must report the defect as soon as it is discovered, but no later than one months after the defect is discovered. However, please note that you may no longer exercise your warranty rights beyond the one month limitation period from the performance of the contract.

Within one months of performance, there are no conditions other than the notification of the error to enforce your warranty claim if you certify that the product or service was provided by Seller. However, after one months from the date of performance, you must prove with photographs emailed to info@agrologica.gr that the defect you identified already existed at the time of performance.

Seller is released from its warranty obligation if it proves that the defect in the product occurred after delivery to the buyer.

The product warranty claim can only be enforced against the manufacturer, under which you can only request the repair or replacement of the defective product.

A product is defective if it does not meet the quality requirements in force at the time of placing on the market or if it does not have the characteristics specified by the manufacturer.

You can assert your product warranty claim within 1 month of the product being placed on the market by the manufacturer. Upon expiry of this period, he shall lose this entitlement.

The manufacturer (distributor) is only released from its product warranty obligation if he can prove that:

the product was not manufactured or marketed in the course of his non – business activities, or
the defect was not recognizable at the time of placing on the market according to the state of the art or
the defect of the product results from the application of legislation or a mandatory official regulation.

151/2003 on the mandatory warranty for certain durable consumer goods. (IX. 22.) defines the cases of the obligatory guarantee. In the case of Products not covered by this case, the Seller does not provide a warranty. The warranty claim can be enforced during the warranty period. If the obligor fails to comply with his obligation to call upon the claimant within a reasonable time, the warranty claim may be enforced in court within three months of the expiry of the time limit set in the call, even if the warranty period has expired. 7. Complaint Handling

Complaints received will be investigated within 30 calendar days. We will take minutes of the complaint, one copy of which will be made available to the buyer. The undertaking must state the reasons for rejecting the complaint. With an unresolved customer complaint, you can turn to the consumer protection inspectorate or the competent conciliation body with a possible dispute.

Any disagreement regarding this contract that cannot be settled amicably and will result in a legal dispute, the parties agree that the Buda District Central Court shall have exclusive jurisdiction.
